Zelfbestuursverordeningen Atjeh en Onderhoorigheden — the third bundle of Aceh self-government regulations, published in 1930 as Serie A No. 9 of the Mededeelingen van de Afdeeling Bestuurszaken der Buitengewesten van het Departement van Binnenlandsch Bestuur — is the printed compilation of twenty-three numbered regulations (Zelfbestuursverordeningen and Zelfbestuursbesluiten) issued between 1912 and 1928 by the Zelfbestuurders — the Oeleebalang and Kepala negeri of the various zelfbesturende landschappen of the Gouvernement Atjeh en Onderhoorigheden — and printed in parallel Dutch and Malay columns by the Landsdrukkerij at Weltevreden. The compilation was the third in a series begun under earlier numbers of the Mededeelingen — its Voorwoord declares that “Het verschijnen van dezen derden bundel zelfbestuursverordeningen beteekent een nieuwe stap in de richting, aangegeven in het voorwoord van nummer 5 dezer Serie van de Mededeelingen” — and it is the most complete single printed record of the operational legal architecture of Dutch indirect rule in Atjeh after the pacification.
Context
The book belongs to the constitutional framework of Dutch indirect rule in Atjeh after the pacification. From 1898 onward, the successive oeleebalang of the coastal and highland landschappen had been bound to the colonial state by the so-called Korte Verklaring — the short political pact by which each signatory acknowledged Dutch sovereignty and promised to follow the Government’s inzichten — and from 1912 onward the metropolitan statute Staatsblad 1919 No. 822 (the Zelfbestuursregelen 1919) supplied the formal framework within which the Zelfbestuurders could issue their own verordeningen. The Zelfbestuursregelen 1927 updated the framework, but the Voorwoord of the present compilation notes that “artikel 26 der zelfbestuursregelen 1927 in dit gewest nog geen toepassing heeft gevonden” — meaning that, in Atjeh, the collective-vaststelling practice (under which all Zelfbestuurders of an onderafdeeling issued their regulations jointly) still prevailed over the single-landschap system the 1927 reform envisaged.
The result was a corpus of regulations issued, throughout the 1910s and 1920s, by the oeleebalang of the onderafdeelingen — Lhoksoekon, Meulaboh, Sigli, Takingeun, Alaslanden, Bireuën, Meureudoe, Lammeulo, Padangtidji, Lhokseumawe, Idi, Tjalang, Langsa, Tamiang, Tapaktoean, the Zuidelijke Atjehsche landschappen and Simeuloe — each regulation subject to the goedkeuring of the Gouverneur van Atjeh en Onderhoorigheden and, in the most important fiscal cases, to the prior vergunning of the Gouverneur-Generaal van Nederlandsch-Indië. The compilation of 1930 is the third bundle of these regulations to appear in the Mededeelingen series; its predecessors (Serie A No. 5 and the unnumbered earlier bundles) had covered the earliest adat-confirming verordeningen of the 1910s.
Structure
The compilation is organised, per its Inhoud (table of contents on pages V–VII), under four headings — Justice, Finances, Administration, and Agriculture/Industry/Trade — covering 23 numbered regulations.
Justitie comprises five regulations: Reg. No. 1 (anti-woeker regeling for the landschappen of the onderafdeeling Lhoksoekon, dated 9 December 1926, based on Staatsblad 1916 No. 643); Reg. No. 10 (Mohammedaan marriage and talak regeling for the onderafdeeling Meureudoe, inwerking 1 January 1918); Reg. No. 11 (the gevaarlijke lectuur en propaganda regeling for the onderafdeeling Idi of 15 November 1924, based on Staatsblad 1919 No. 822); Reg. No. 12 (supervision of Mohammedaan religious instruction for the landschappen of the onderafdeeling Lhoksoekon, 30 November 1925); and Reg. No. 13 (supervision of blacksmithing and manufacture of blanke wapenen in the onderafdeeling Tjalang, 8 January 1927).
Financiën comprises eight regulations: Reg. No. 2 (the originating Pantjang Alas regeling for the landschap Meulaboh of 5 April 1912); Reg. No. 3 (the Gouverneursbesluit of 12 April 1912 No. 247/18 establishing heffing-rules for the Pantjang Alas across the entire Gouvernement); Reg. Nos. 4a–4c (the revised Pantjang Alas regeling for the afdeeling Pidie of 27 July 1925, with its uitvoeringsbesluiten for Sigli and Takingeun); Reg. No. 5 (the cattle-slaughter tax regeling for the onderafdeeling Alaslanden of 1 March 1914, modified 28 April 1924); Reg. No. 6 (the vee-uitvoerheffing for the gebied van Rädjö Boekét in Takingeun of 1 December 1917); Reg. No. 7 (the vee-uitvoerheffing for Meureudoe, inwerking 1 July 1918); Reg. No. 8 (the verkoop-heffing on onroerende goederen for Lhokseumawe of 1 January 1918); and Reg. Nos. 9a–9b (the inkomstenbelasting regeling for the landschap Peureula’ of 20 December 1920, with its Nota van Toelichting).
Bestuur comprises Reg. No. 14, the heerendienst (corvée) regeling of 18 August 1928 for the onderafdeeling Bireuën, which became the model for parallel regelingen in all eighteen other onderafdeelingen, all entering force on 1 January 1929.
Landbouw, Nijverheid en Handel comprises Reg. Nos. 15–23, ranging from the schoolgeld-regeling for the landschap Teunom-Panga (4 August 1917) and the cattle-transport regeling for Alaslanden (16 September 1914), through the Klapperverordening (25 August 1916) and the tjemaraboomen-regeling of 2 July 1917 for Meulaboh, to the alang-alang regelingen for Takingeun (20 May 1924) and Pidië (21 January 1928), with Reg. No. 21 — the natuurmonument designation for the Rafflesia sites of the landschap Serbeudjadi (1 January 1921) — the most botanically distinctive entry.
Bilingual form
Every regulation in the compilation is printed in parallel Dutch and Malay (or rather the colonial Maleisch of the 1910s–1920s) columns, the Dutch article headed Artikel and its Malay counterpart headed Fatsal (from Arabic faṣl, “chapter”). The vaststelling-formula itself is bilingual: each regulation opens with a Menimbang / Overwegende recital in parallel Malay and Dutch, then the signatory oeleebalang (in Malay Kami Oeleebalang dari …) state their authority under Staatsblad 1919 No. 822 — Gelet op Staatsblad 1919 No. 822 / Diperhatikan boenjinja Staatsblad 1919 No. 822 — to issue the regulation. The closing formula is likewise bilingual: “Peratoeran ini didjalankan dari tanggal …” / “Deze verordening treedt in werking op …”.
Each regulation carries the formal approval of the Civiele en Militaire Gouverneur van Atjeh en Onderhoorigheden — the printed note “(goedgekeurd door den Gouverneur van Atjeh en Onderhoorigheden op …)” — and, in the most important fiscal cases (notably the Pantjang Alas of 1912 and the inkomstenbelasting of 1920), the prior vergunning of the Gouverneur-Generaal van Nederlandsch-Indië, obtained by telegram. The compilation also includes the formal Gouverneursbesluiten issued by the Civiel en Militair Gouverneur himself — Reg. No. 3 (the Pantjang Alas heffing-besluit of 12 April 1912 No. 247/18) and Reg. No. 15b (the schoolgeld-administratie besluit of 4 August 1917) — which stand alongside the Zelfbestuursverordeningen as part of the same operational corpus.
Significance
The compilation is the operational legal foundation of the colonial-zelfbestuur hybrid in Atjeh from 1912 to 1928. It records, in twenty-three bilingual regulations and their comparative tables of Gelijke Verordeningen, the systematic extension of a single fiscal-and-administrative template — the Pantjang Alas, the slachtpadjak, the vee-uitvoerheffing, the inkomstenbelasting, the heerendienst, the schoolgeld — across all eighteen onderafdeelingen of the Gouvernement, each onderafdeeling issuing its parallel regulation in a slightly different year, but with the text and tariff structure remaining broadly identical. The compilation thus reveals, in a way no narrative colonial report could, how the Dutch colonial state actually governed Atjeh after the pacification: by inducing its Zelfbestuurders to legislate, in their own name and in their own Malay, the very fiscal and police measures the metropolis desired, with the Civiel en Militair Gouverneur supplying only the goedkeuring. Reg. No. 9b — the Nota van Toelichting on the inkomstenbelasting — even makes the constitutional logic explicit, citing the Korte Verklaring (in Malay soerat Ikrar) and the Nota over politick beleid en bestuurszorg in de Buitenbezittingen to explain why “de onderworpenheid van het Atjehsche Zelfbestuur aan het Europeesch gezag in het algemeen reeds uit de Korte Verklaringen voortvloeit”. The book is therefore not only a legal reference work but a primary source for the constitutional theory of Dutch indirect rule in Atjeh under the Zelfbestuursregelen of 1919 and 1927.
