The Zelfbestuurs-ordonnantie (“Self-Government Ordinance,” Stbl. 1914 No. 24) was the Dutch colonial ordinance promulgated in 1914 that codified the rights, competences, and obligations of the Gouvernement on one hand and of the zelfbesturen (self-governing territories) on the other under the regime of the Korte Verklaring that had been in force since 1899. In the Encyclopaedisch Bureau’s account, the ordinance was the legal capstone of the post-pacification order in Atjeh and the wider Buitenbezittingen: the ordinance that translated the de facto extension of Dutch authority since the betrayal of Toekoe Oemar in 1896 into a de jure framework of colonial governance. The ordinance was the formal legal outcome of the theoretical and practical discussions conducted during the 1913–1914 administrative reform consultations held across Sumatra.
Account from De Buitenbezittingen (1917) — Zelfbestuurs-ordonnantie
The Encyclopaedisch Bureau’s account of the Zelfbestuurs-ordonnantie appears in the chapter on administrative organisation. The Bureau frames the ordinance as the codification of the rights, competences, and obligations of the Gouvernement and the zelfbesturen under the Korte Verklaring regime: “in accordance with the purpose of the K. V. [Korte Verklaring], in order to give the desired guidance to the administrative gesture of the local officials, [the Gouvernement regulated] the direction in which our indispensable involvement with the landschappen must move, and the principles on which we must base our action — in short, the rights, competences, and obligations of the Gouvernement on one hand and of the zelfbesturen under vigueur of the K. V. on the other — by the soon-to-be-enacted ordinance (Stbl. 1914 No. 24), whose provisions mainly correspond with the provisions of the detailed political contracts.”
The Bureau notes that the ordinance’s provisions “mainly correspond with the provisions of the detailed political contracts” — that is, the politieke contracten that the Korte Verklaring had progressively replaced since 1899. The ordinance thus represented not a radical break with the older contractual tradition but a codification of the new Korte Verklaring regime in terms continuous with the older one — a continuity that the Bureau frames as the legal expression of the broader post-1896 Dutch strategic reorientation.
The Bureau also identifies the principal innovation of the new ordinance: the principle that “the revenues of the landschap, instead of being — as formerly — considered as the private revenues of the rulers, who only inadequately spent a part of them for the benefit of land and people, belong to the landschap and must therefore be paid into a landschapskas (territorial treasury), in order to fund from it all kinds of expenditures in the interest of land and people, including — under our guidance and oversight — the income of the rulers in the form of a ‘civiele lijst’.” This principle — the principle of the landschapskassen — is identified by the Bureau as the principal innovation of the newer regulation of the political relationship, whether laid down in contracts or in the Korte Verklaring.
Significance
The Zelfbestuurs-ordonnantie of 1914 is, in the Encyclopaedisch Bureau’s account, the legal capstone of the post-1896 pacification of Atjeh and the wider post-1902 extension of Dutch “effective authority” across the Buitenbezittingen. The ordinance’s codification of the Korte Verklaring regime, its formal establishment of the landschapskassen principle, and its provision for the “civiele lijst” of the native rulers together mark the legal consolidation of the new colonial order — the order that the post-pacification administrative, financial, and police innovations of the 1904–1914 decade had been building toward.
The Zelfbestuursverordening — the operational instrument under the ordonnantie
The 1914 ordonnantie was the constitutional framework; the operational instrument issued under it was the Zelfbestuursverordening — a verordening (ordinance) issued by a Zelfbestuurder (self-governing native chief) of a landschap in Atjeh en Onderhoorigheden, subject to the goedkeuring (approval) of the Civiel en Militair Gouverneur van Atjeh en Onderhoorigheden. The collective body of zelfbestuursverordeningen issued between 1912 and 1928 — twenty-three numbered regulations in all — was compiled in the Zelfbestuursverordeningen Atjeh en Onderhoorigheden of 1930, Serie A No. 9 of the Mededeelingen van de Afdeeling Bestuurszaken der Buitengewesten van het Departement van Binnenlandsch Bestuur, printed in parallel Dutch and Malay columns by the Landsdrukkerij at Weltevreden. Each Zelfbestuursverordening opened with a bilingual Menimbang / Overwegende recital, was issued in the name of “Kami Oeleebalang dari …” / “De Zelfbesturen van …”, carried the printed note of the Gouverneur’s goedkeuring, and was extended to the other onderafdeelingen of the Gouvernement through comparative tables of Gelijke Verordeningen.
The legal form of the verordening
The Zelfbestuursverordening was, in legal form, a verordening — an ordinance — issued under the authority of the Zelfbestuursregelen 1919 (Staatsblad 1919 No. 822) and the Zelfbestuursregelen 1927 by the Zelfbestuurder of a landschap. The opening formula of every regulation in the compilation fixes the form. The recital grounds the regulation explicitly in the metropolitan statute — Reg. No. 1 (the Lhoksoekon anti-woeker regulation of 9 December 1926) opens:
“Menimbang bahasa perloe oentoek sekalian pendoedoek negeri akan menetapkan satoe peratoeran oentoek pentjegah riba seperti ditetapkan dalam Stantshlad 1916 No. 643”
/ “Overwegende dat het gewenscht is voor de zelfbestuurslanden in deze landschappen een regeling tot bestrijding van den woeker vast te stellen, overeenkomende met de regeling vermeld in Staatsblad 1916 No. 643”. The recital then recites the statutory basis — “Gelet op de zelfbestuursregelen 1919 (Staatsblad No. 822)” / “Mengingat peratoeran zelfbesturen 1919 (Staatsblad No. 822)” — and the signatory oeleebalang “Hebben besloten: Vast te stellen de volgende verordening …” / “Ditetapkan: Atoeran oentoek …”. The closing formula fixes the inwerkingtreding: “Peratoeran ini didjalankan pada …” / “Deze regeling treedt in werking op …”.
A second form — the Zelfbestuursbesluit — was used for implementing decisions (uitvoeringsvoorschriften) and instructies rather than for substantive regulations. Reg. No. 4b (the Zelfbestuursbesluit of 27 July 1925 issuing uitvoeringsvoorschriften for the Pantjang Alas of Sigli), Reg. No. 4c (the Zelfbestuursbesluit of 1 October 1926 issuing uitvoeringsvoorschriften for the Pantjang Alas of Takingeun), Reg. No. 18b (the Zelfbestuursbesluit of 25 August 1916 issuing an instructie for the klappercultuur-mantri’s of Lhoksoekon), and Reg. No. 20 (the Zelfbestuursbesluit of 15 July 1917 issuing an instructie for the veemantri’s of Bireuën) are all besluiten rather than verordeningen in the strict sense — but the compilation prints them under the same numbering, and they share the same bilingual form, the same goedkeuring requirement, and the same collective vaststelling practice as the verordeningen proper.
The goedkeuring requirement
The constitutional requirement that fixed the subordination of the Zelfbestuur to the colonial state was the goedkeuring — the approval — that every Zelfbestuursverordening and Zelfbestuursbesluit had to obtain from the Gouverneur van Atjeh en Onderhoorigheden before taking effect. Every regulation in the 1930 compilation carries the printed note “(goedgekeurd door den Gouverneur van Atjeh en Onderhoorigheden op …)” — approved by the Gouverneur of Atjeh en Onderhoorigheden on [date] — together with the date of the goedkeuring. Reg. No. 1 (the Lhoksoekon woeker-regulation) is “(goedgekeurd door den Gouverneur van Atjeh en Onderhoorigheden op 21 December 1926)”; Reg. No. 5 (the Alaslanden slachtpadjak) is “(goedgekeurd door den Gouverneur van Atjeh en Onderhoorigheden) zooals gewijzigd bij de zelfbestuursverordening van 28 April 1924 (goedgekeurd door den Gouverneur van Atjeh en Onderhoorigheden op 30 Mei 1924)”; Reg. No. 11 (the Idi gevaarlijke lectuur regulation) is “(goedgekeurd door den Gouverneur van Atjeh en Onderhoorigheden op 11 December 1924)”.
The most important fiscal cases required, in addition, the prior vergunning (permission) of the Gouverneur-Generaal van Nederlandsch-Indië, obtained by telegram. Reg. No. 5 (the Alaslanden slachtpadjak of 1 March 1914) recites the Gouverneur-Generaal’s authorisation:
“Soedah ditimbang menoeroet be-enjinja kawat Gouvernements Secretaris tanggal 13 April 1912 No. 454 dan soerat wakil Gouvernements Secretaris tanggal 15 Juli 1913 No. 1726 diberi izin akan mengadakan oeang padjak memotong sapi, kerbau dan babi djinak pada jang mempoenjai djadjahan”
— “Whereas, pursuant to the telegram of the Gouvernements Secretaris of 13 April 1912 No. 454 and the letter of the Gouvernements Secretaris of 15 July 1913 No. 1726, permission was granted to levy a slaughter tax on cattle, buffaloes, and tame pigs of those having djadjahan”. The goedkeuring requirement was, in this sense, the operational counterpart of the Korte Verklaring’s political subordination: where the Korte Verklaring bound the oeleebalang to the colonial state in form, the goedkeuring requirement bound him in operational practice — the operational complement to the 1914 ordonnantie’s codification of the supervisory framework.
The bilingual Dutch-Malay text form
Every Zelfbestuursverordening in the compilation is printed in parallel Dutch and Malay (or rather the colonial Maleisch of the 1910s–1920s) columns. The Dutch article is headed Artikel and its Malay counterpart is headed Fatsal (from Arabic faṣl, “chapter”). The signatory clauses are likewise bilingual: in Malay “Kami Oeleebalang dari Landschap …”, in Dutch “De Zelfbesturen van de landschappen: …”. The recitals are bilingual: in Malay “Menimbang …”, in Dutch “Overwegende …”. The statutory recitation is bilingual: in Malay “Mengingat peratoeran zelfbesturen 1919 (Staatsblad No. 822)”, in Dutch “Gelet op de zelfbestuursregelen 1919 (Staatsblad No. 822)”. The vaststellungs-formula is bilingual: in Malay “Ditetapkan”, in Dutch “Hebben besloten”. The closing formula is bilingual: in Malay “Peratoeran ini dimoelai pada 1 April 1914” (Reg. No. 5, Fatsal 10), in Dutch “Deze regeling treedt in werking op 1 April 1914” (Reg. No. 5, Artikel 10).
The bilingual form was the operational expression of the Zelfbestuur’s constitutional position: the oeleebalang legislated in his own Malay — the language of the anak negeri (the indigenous subjects of the landschap) — while the colonial state supervised in Dutch. The Malay text was the operative instrument binding on the anak negeri; the Dutch text was the supervisory text by which the Plaatselijk Besturend Ambtenaar and the Civiel en Militair Gouverneur exercised contrôle. The bilingual form thus fixed, in the very typography of the page, the dual Islamic-and-colonial legal register in which the Zelfbestuur’s verordeningen of Atjeh operated — the operational expression of the 1914 ordonnantie’s framework in the specific Atjehsche context.
The collective vaststelling practice
The goedkeuring requirement was combined, in the operational order of the Zelfbestuur, with the collective vaststelling practice that characterised the Atjehsche regulations. The Voorwoord of the 1930 compilation records that “de vaststelling van verordeningen in het gewest Atjeh en Onderhoorigheden steeds collectief geschiedt” — the establishment of ordinances in the gewest Atjeh en Onderhoorigheden always takes place collectively — meaning that all Zelfbestuurders of an onderafdeeling — sometimes of an afdeeling — issued their regulations jointly. The 24 Zelfbestuurders of the Pidië landschappen, for example, jointly issued Reg. No. 4a of 27 July 1925; the three oeleebalang of Samalanga, Peusangan, and Gloempang-doea jointly issued Reg. No. 14 of 18 August 1928; the ten oeleebalang of Sawang, Nisam, Tjoenda, Lhoseumawe, Bajoe, Blang Mangat, Samakoero, Blocë, Geudong, and Blang Me jointly issued Reg. No. 8 of 1 January 1918. The collective vaststelling practice was, in the 1930 compilation, the operational expression of the Zelfbestuur’s collective authority — the constitutional form by which the oeleebalang of an onderafdeeling legislated, in their own name and in their own Malay, the very fiscal and police measures the colonial state desired — the operational expression of the 1914 ordonnantie’s framework.
Citation form
The Zelfbestuursverordeningen of the 1930 compilation are conventionally cited in the form “Zelfbestuursverordening van [date] ([subject])” or, with the compilation’s own Reg.-numbering, “Reg. No. N (Zelfbestuursverordening van [date])”. Thus: “Zelfbestuursverordening van 9 December 1926 (Lhoksoekon woeker)” = Reg. No. 1; “Zelfbestuursverordening van 1 Maart 1914 (Alaslanden slachtbelasting)” = Reg. No. 5; “Zelfbestuursverordening van 16 September 1914 (Alaslanden vee)” = Reg. No. 16; “Zelfbestuursverordening van 1 Augustus 1927 (Zuid-Atjeh vrouwelijk vee)” = Reg. No. 17; “Zelfbestuursbesluit van 15 Juli 1917 (Bireuen veemantri)” = Reg. No. 20. The Zelfbestuursbesluiten are cited in the same form, with “Besluit” substituted for “Verordening”. When the regulation has been modified by a later verordening, the citation includes the modification: “Zelfbestuursverordening van 1 Maart 1914, zooals gewijzigd bij de zelfbestuursverordening van 28 April 1924”.
Significance of the Zelfbestuursverordening
The Zelfbestuursverordening’s significance in the Aceh Wiki History record rests on four things: it was the legal instrument by which the Zelfbestuurders of Atjeh en Onderhoorigheden — the oeleebalang of the landschappen — legislated, in their own name and in their own Malay, the fiscal, police, agricultural, and administrative measures the colonial state desired, subject to the goedkeuring of the Civiel en Militair Gouverneur; it was the instrument whose bilingual Dutch-Malay form fixed, in the very typography of the page, the dual Islamic-and-colonial legal register in which the Zelfbestuur’s verordeningen operated — the Malay text binding on the anak negeri, the Dutch text the supervisory instrument of the Plaatselijk Besturend Ambtenaar and the Civiel en Militair Gouverneur; it was the instrument whose collective vaststelling practice — under which all Zelfbestuurders of an onderafdeeling issued their regulations jointly, and whose parallel regelingen were extended to all other onderafdeelingen through comparative tables of Gelijke Verordeningen — preserved, throughout the 1910s and 1920s, the operational expression of the Zelfbestuur’s collective authority; and it was the instrument that constitutes the Zelfbestuursverordeningen compilation of 1930 — the most complete single printed record of the operational legal architecture of Dutch indirect rule in Atjeh after the pacification, and the primary source for the operational implementation of the 1914 ordonnantie’s framework in the Atjehsche context.
