Staatsblad No. 85 van 1885 — the Staatsblad van Nederlandsch-Indië No. 85 of 1885 (Netherlands-Indies Statute Book No. 85 of 1885), by which the Regeering (Government) formally repealed the rigorous-blockade statute Staatsblad No. 105 of 1884 — is the legal instrument by which the colony abandoned, after less than a year of partieele (partial) application, the rigoureuse blokkade (rigorous blockade) prescribed as the kracht (strength) component of the Concentratiebesluit of 19 August 1884. The repeal was the formal admission by the Regeering that the blokkade algemeen had moeten zijn om het beoogde doel te bereiken, maar slechts teleurstellingen kon baren toen zij slechts partieel werd toegepast (the blockade would have had to be general to attain the intended aim, but could only produce disappointments when it was only partially applied). The repeal statute is, in Van Heutsz’s 1893 tract De onderwerping van Atjeh, the legal close of the most disastrous single year of the Atjeh-oorlog — the year in which the colony abandoned both the conquests of Generaal van der Heijden and the scheepvaartregeling (shipping regulation) of Scherer and Laging Tobias — and the legal prelude to the survival of Demmeni’s soort scheepvaartregeling (a kind of shipping regulation) “voor sommige kuststaten” (for some coastal statelets) until the end of 1885, when that too was abolished by the Regeering.
The repeal
The repeal statute — Staatsblad No. 85 of 1885 — was promulgated in the course of 1885, after less than a year of partieele (partial) application of the Staatsblad No. 105 of 1884 blockade. Van Heutsz records the repeal in his account of the correspondence between the Regeering in Indië (Government in the Indies), the Opperbestuur in Nederland (Supreme Government in the Netherlands), and the Gouverneur van Atjeh (Governor of Atjeh):
“werd bij Staatsblad No 85 van 1885 het Staatsblad No 105 van 1884 ingetrokken, bij welke intrekking de Regeering de zeer juiste opmerking voegde, dat de blokkade algemeen had moeten zijn om het beoogde doel te bereiken, maar slechts teleurstellingen kon baren toen zij slechts partieel werd toegepast en een groot gedeelte van het kustgebied voor den handel openbleef”.
The repeal was accompanied by the simultaneous reduction of the marine force that had been deployed to Atjeh for the sluiting (closure): “De voor de sluiting naar Atjeh gezonden groote marinemacht werd tegelijkertijd teruggebracht tot enkele schepen” — the great marine force sent to Atjeh for the closure was simultaneously reduced to a few ships. The repeal and the marine reduction together marked the formal close of the concentratiestelsel (concentration system)‘s kracht (strength) component, leaving the colony with only the geconcentreerde stelling (concentrated defensive line) and the non-interventie (non-intervention) of the eerste deel (first part) of the stelsel (system).
The reasons: Demmeni’s opposition, Scherer’s notes, the failure of partial application
The repeal had three principal causes in Van Heutsz’s reading: the opposition of Generaal Demmeni to the blokkade (blockade) on the merits; the betoogingen (arguments) and nota’s (memoranda) of Scherer co-signed by assistent-resident van Langen that had wankelde (wavered) Demmeni into the partieele application in the first place; and the operational failure of the partieele blokkade (partial blockade) itself. Van Heutsz records the opposition of Demmeni:
“dat uit die briefwisseling, gepaard met voorstellen uit Atjeh, gebleken was, dat de Generaal Demmeni van eene blokkade voor Atjeh in ‘t geheel geen heil verwachtte, omdat, op grond vooral van de vermeende voldoende voedingsmiddelen in het binnenland, naar zijne overtuiging, daarmede het doel dat er door beoogd werd: het bedwingen van het voortdurend verzet in Groot-Atjeh door het uitoefenen van dwang op de onderhoorige kuststaten, niet te bereiken was”.
Demmeni’s opposition — that “van eene blokkade voor Atjeh in ‘t geheel geen heil verwachtte” (expected no benefit at all from a blockade of Atjeh) — was grounded in his judgement that the binnenland (interior) had sufficient food and that the bedwingen van het voortdurend verzet in Groot-Atjeh door het uitoefenen van dwang op de onderhoorige kuststaten (suppression of the continuous resistance in Groot-Atjeh by exercising coercion on the dependent coastal statelets) was not, by the blockade, to be attained. Van Heutsz refutes the vermeende voldoende voedingsmiddelen (supposed sufficient foodstuffs) argument at length elsewhere in the tract — pointing to the groote hoeveelheden rijst (great quantities of rice) that had been imported into Groot-Atjeh through Oleh-leh in 1876 and to the closure of the Pedir rice supply in 1876 and 1877 — but concedes that the operational failure of the partieele blokkade itself confirmed Demmeni’s pessimism: “slechts teleurstellingen kon baren toen zij slechts partieel werd toegepast en een groot gedeelte van het kustgebied voor den handel openbleef”. The Scherer nota’s that had wankelde Demmeni into the partieele application were the same nota’s by which Scherer, before his departure in early October 1884, had warned the General “ernstig tegen het opheffen der scheepvaartregeling en van de posten op de kust” (seriously against the abolition of the shipping regulation and of the posts on the coast) — and their effect was, in Van Heutsz’s reading, to produce the worst of both worlds: a partieele blokkade that produced teleurstellingen (disappointments) and a soort scheepvaartregeling that, in Van Heutsz’s phrase, “niet deugde” (was no good).
The survival of the scheepvaartregeling until end-1885
The repeal of Staatsblad No. 105 of 1884 did not, however, immediately abolish the soort scheepvaartregeling (a kind of shipping regulation) that Demmeni had introduced by his besluit (decree) of 13 October 1884. Van Heutsz records the survival:
“De door den Generaal voor sommige kuststaten ingevoerde scheepvaartregeling bleef intusschen nog in stand tot ongeveer het einde van het jaar 1885, niettegenstaande de Regeering bij de intrekking van de blokkade had te kennen gegeven, dat nu voortaan de te volgen politieke gedragslijn zou zijn: volkomen vrijheid van handel in verband met non-interventie in de binnenlandsche aangelegenheden van de kuststaten”.
The scheepvaartregeling thus survived, for the somminge kuststaten (some coastal statelets), until December 1885, when it too was abolished: “Eindelijk echter werd ook die scheepvaartregeling waartegen èn Regeering in Indië èn Opperbestuur in Nederland overwegende bezwaren hadden, die door de vertoogen uit Atjeh niet werden weggeruimd en ook moeilijk weg te ruimen waren, omdat die regeling, zooals uit het medegedeelde op bladz. 3 duidelijk is, werkelijk niet deugde, in December 1885 door de Regeering ingetrokken en tevens voor den vervolge zelfs de geringste beperking van den handel der kuststaten met het buitenland, onder welken vorm ook, verboden”. The abolition of December 1885 was, in Van Heutsz’s reading, the third and final stage of the colony’s self-disarmament: the blokkade (blockade) repealed by Staatsblad No. 85 of 1885, the soort scheepvaartregeling abolished in December 1885, and “tevens voor den vervolge zelfs de geringste beperking van den handel der kuststaten met het buitenland, onder welken vorm ook, verboden” — at the same time, even the slightest restriction on the trade of the coastal statelets with the outside world, in whatever form, was forbidden for the future. The vrije handel (free trade) and the non-interventie that would, in Van Heutsz’s reading, define the colony’s Atjeh policy for the next several years were thus established by the legal close of 1885.
Significance
Staatsblad No. 85 of 1885 is, in Van Heutsz’s narrative, the legal close of the most disastrous single year of the Atjeh-oorlog — the year in which the colony abandoned both the conquests of Generaal van der Heijden and the scheepvaartregeling of Scherer and Laging Tobias. Its significance in the Aceh Wiki History record lies in four things. First, it formally repealed the rigorous-blockade statute Staatsblad No. 105 of 1884 after less than a year of partieele application, with the Regeering’s own admission that “de blokkade algemeen had moeten zijn om het beoogde doel te bereiken, maar slechts teleurstellingen kon baren toen zij slechts partieel werd toegepast” — the formal admission that the partieele blokkade of 13 October 1884 had been an operational failure. Second, it was accompanied by the simultaneous reduction of the marine force — “De voor de sluiting naar Atjeh gezonden groote marinemacht werd tegelijkertijd teruggebracht tot enkele schepen” — and thus marked the formal close of the concentratiestelsel’s kracht component, leaving the colony with only the geconcentreerde stelling and the non-interventie. Fourth, it was the legal prelude to the pacification (pacification) of 1886–1891 that Van Heutsz’s 1893 tract was written to reverse: the scheepvaartregeling of Scherer’s Nota of 19 April 1880 — the long-deferred alternative that Van Heutsz would himself implement, in modified form, as Gouverneur van Atjeh from 1898 onward — was, in Van Heutsz’s reading, the gewichtige antwoord op de vraag van Pel (weighty answer to the question of Pel) that the 1885 repeal made all the more urgent.
