The haq toeleuèng was the right, granted in Atjeh to a new occupant defeated in a suit over a garden or ladang, to continue working the ground on condition of delivering to the proven original possessor the so-called haq tano or haq lampoih.
In the law of garden disputes
Where the clearance and taking into use concerned waste land fit only for laying out a garden or ladang, a person claiming to have used the terrain earlier had to point, with his witnesses, to traces of previous working — either trees or shrubs surviving from an earlier crop, or the remnants of a former pageue (fence). If the plaintiff’s rights to the garden or ladang were proved, the garden might either be awarded to him outright, or the new occupant might be granted the haq toeleuèng.
The counter-obligation
The haq toeleuèng was conditional on delivery to the proven original possessor of the haq tano (tano, ground) or haq lampoih (lampoih, garden), amounting to half of the yield if the land in question lay within the gampong boundaries, and one-third of the product if it lay outside the gampong, that is in the forest or in the mountains. Against this stood a counter-obligation on the original possessor and successful plaintiff: he had to supply the bibit (seed). If the new clearer and defeated party would not accept these terms, he lost all right.
The Sigli variant
In the Siglische district the haq toeleuèng occurred in a somewhat different form. There a person might obtain on a gampong yard the right of working for the planting of intercrops, the yield of which was entirely his own, but with the obligation to plant coconuts or other perennial crops for the owner of the ground, without receiving any share of these — unless he also provided the bibit himself, in which case half of the yield fell to him.
